PANALO ANG BUONG DABARKADS!
Inilabas na ang desisyon ng Marikina Regional Court na pumabor sa trio na sina Tito, Vic & Joey sa pag-aari ng trademark na “Eat Bulaga” laban sa Television and Production Exponents Inc. (TAPE) hinggil sa kaso ng copyright infringement at unfair competition.Naglabas din ng kaparehong desisyon ang Intellectual Property Office of the Philippines (IPO) na nagpapabor sa trio na sina Tito, Vic & Joey.
Sa isang balita mula sa TV5, ibinahagi ang nilalaman ng desisyon ng Marikina Regional Trial Court na nilagdaan ni Presiding Judge Romeo Dizon Tagra noong December 22, 2023:
“Having been ruled as the owners of the trademark Eat Bulaga and its called Logos, plaintiffs Tito, Vic and Joey, therefore have the clear and unmistakable right over the subject mark and logos which have been materially and substantially violated by defendant TAPE’s unauthorized thereof. Defendant TAPE should therefore be permanently enjoined from using the name.”
Ipinag-utos pa ng korte na bayaran ng TAPE ang plaintiffs ng tatlong (3) milyong piso kasama na ang mga damages at attorney’s fee.
“Moreover, defendant Television and Production Exponents, Inc. is directed to pay plaintiffs the following sums:
1. Temperate damages of P1,000,000.00 each, or a total of P2,000,000.00 for committing unfair competition and copyright infringement against the plaintiffs, respectively;
2. Exemplary damages of P500,000.00; and
3. Attorneys’s fee of P500,000.00.”
Kasabay nito, isinagawa ng TVJ ang isang live announcement sa kanilang Facebook page noong January 5, 2024, 5 p.m. Pinangunahan ito ni Former Senate President Tito sa pamamagitan ng pagbabasa ng email na kanyang natanggap. Nakapaloob sa resolution na kanyang binasa ang utos sa TAPE at GMA na itigil ang pag-ere ng mga lumang clips ng mga segments ng Eat Bulaga simula noong May 31, 2023.
“Wherefore, judgment is hereby rendered in favor of the plaintiffs against the defendants, permanently enjoining defendants, Television and Production Exponents, Inc. (TAPE) and GMA Network Inc. from
1. Using the trademarks EB and Eat Bulaga including all the logos associated with the subject perks in its shows, programs, projects, or promotions; and
2. Using the Eat Bulaga jingles/songs or any part thereof in its shows, programs, projects, or promotions; and
3. Airing and broadcasting a playback of any and all recorded episodes of the Eat Bulaga show prior to 31st May 2023, its segments, or any portion thereof in all channels and platforms…”, wika ni Tito Sotto.
“Pursuant to sections 151-2 and 161 of Republic Act 8293, ito po yung Intellectual Property Office. Sabi, the Intellectual Property Office of the Philippines through its proper unit/head officer is hereby directed to cause the cancellation of the following trademark registrations in the names of Television and Production Exponents, Inc. (TAPE) from its records, database, and/or registry to it,” dagdag pa niya.
Naging emosyonal ang trio hosts at mga staff ng E.A.T sa TV5, kasabay ng mga palakpakan at mga hiwayan ng mga dabarkads.
“Tayo po ang may-ari ng Eat Bulaga,” sabi ni Tito Sen. “Maraming salamat po sa inyong pagtangkilik, maraming salamat po sa pagdarasal, una sa lahat sa Panginoong Diyos. Thank you very much, Lord God, thank you” - sabi pa niya. “Sa madaling salita, atin talaga ang Eat Bulaga,” sambit ni Vic Sotto.
